REASON FOR RULING
This is an application by the defendant that, inter alia, paragraph 2 of the Order dated 9th April 1998 be varied allowing the removal of the requirement of the payment into Court by the defendant of the amount of US$125,000.00 as a condition of the setting aside of the Default Interlocutory Judgment obtained by the plaintiff on 10th March 1998 at the filing of the defence.
When the original order was made at the hearing on 9th April 1998, it was submitted, and supported by evidence that the defendant had at his disposal the amount of $125,000.00. This although not specifically conceded by the defence, was not denied and accordingly the above order was made.
