Circumstances of Offence:
The accused attacked his wife with a baseball bat, breaking one of her arms in several places. The wife gave evidence on oath that she had forgiven her husband and wished to continue living with him. It was accepted that the accused had shown real remorse for his behaviour. He pleaded guilty on the first available opportunity.

Circumstances of Accused:
- Minor convictions in the past. Aggravated assault in 1997.
- Caymanian. No record for violent offences.

Disposition:
Due to the wife's forgiveness, what could have been a long custodial sentence was suspended. The accused was sentenced to 2 years suspended for 2 years, with a fine of $600 and costs.
