Commissiong Respondents: Mr. Anthony Astaphan, SC with Mr. Joseph Delves Issue: Costs Order of the Court of Appeal Result: Paragraph 3 of the Order of 7th April, 2008 which reads, “The respondents shall meet the appellant’s costs in the High Court to be assessed on the basis of rule 65.11 of CPR 2000 and one half of the appellant’s costs in these proceedings under rule 65.13(b) of CPR 2000” was amended as follows: “The respondents shall meet one half of the appellant’s costs in these appeal proceedings to be assessed on the basis of rule 65.11 of CPR 2000 and rule 65(13) (b) of CPR 2000.” Reason: There was no appeal against costs so it was erroneous for the Court of Appeal to make an order for costs in the court below. The parties agreed to amend the judgment and order.
