TELECONFERENCE ANGUILLA 19th November 2013 APPLICATION AND APPEAL Case Name: Joseph Brice v Regina [AXAHCRAP2013/0001] Before: The Hon. Dame Janice M. Pereira, Chief Justice Appearances: Applicant / Appellant: Mr. Horace Fraser Respondent: Mr. Ivor Greene with him Ms. Mary Claire Haskins Issue: Application for conditions of bail to be varied Result / Order: [Oral delivery] The order granting bail to the appellant dated 15th April 2013 is hereby varied as follows:
1.The applicant is admitted to bail in the sum of $150,000.00 with two sureties.
2.The applicant’s passport shall be returned to him on the execution of the bond of surety to enable the applicant to travel from the Territory of Anguilla to the state of Saint Lucia on Tuesday, 19th day of November 2013 and returning to the Territory of Anguilla no later than Sunday, 24th day of November 2013.
3.The applicant shall be released from the reporting condition in paragraph 3 contained in order dated 15th April 2013 for the period commencing 19th day of November 2013 to 24th day of November 2013 but shall upon return to the Territory of Anguilla report to The Valley Police Station no later than 9:00a.m Monday, 25th November 2013.
4.The applicant is hereby permitted to leave the Territory of Anguilla only in accordance with paragraphs 1, 2 and 3 hereof.
5.This variation of the order granting bail dated 15th April 2103 shall remain in effect during the period 19th day of November 2013 to 24th day of November 2013 and thereafter this variation of the order shall cease to have effect and the order of bail dated 15th April 2013 and the terms and conditions thereof shall continue to be in effect.
