Reason: The Court was mindful of section 48(10) of the Court of Appeal Rules of the Eastern Caribbean Supreme Court which states that a transcript of the shorthand notes taken at trial shall not be supplied free of charge except by an Order of the Court on an application made by the appellant. In this regard, the court was of the view that proof of impecuniosity was necessary in order to grant such an application. As the applicant had not provided any proof of his impecuniosity upon making his application, the court was minded to adjourn the application to allow the applicant to furnish the Court with such evidence.
