Counsel also informed the court that the notes of evidence are not agreed in the sense that the accounts vary in some instances as counsel may have paraphrased the wording of events as opposed to taking a verbatim account. As a result, each party will file their notes. The variance however is not material. The Court therefore asked that a joint document be filed noting where the notes differ.
