Reason: The Court noted that the appellant was incarcerated in relation to other matters and had been released and since left the jurisdiction. The Court noted that counsel for the appellant was not able to contact the appellant to take instructions and that he would be filing a notice of discontinuance in the matter. The court advised that the appropriate filing would be a Notice of Abandonment, which must be signed by the appellant himself but also noted that it would not be appropriate for counsel to discontinue the matter without receiving those specific instructions from the appellant. The Court was therefore minded to adjourn the matter to allow counsel to make contact with the appellant to discuss the way forward.
