The Court also noted that it was left to be determined what is to be done in relation to the extant appeal and the application. Michael Bourne Respondent: Ms. Jordia Hodge Issues: Status of the matter Type of Order: Adjournment Result / Order: [Oral Delivery] IT IS HEREBY ORDERED THAT: The matter is adjourned to the next status hearing of the court of appeal for the Territory of Anguilla scheduled for 22nd September 2025, to allow the appellant to indicate whether he is still interested in prosecuting the appeal. Reason: The Court noted that the appellant was incarcerated in relation to other matters and had been released and since left the jurisdiction. The Court noted that counsel for the appellant was not able to contact the appellant to take instructions and that he would be filing a notice of discontinuance in the matter. The court advised that the appropriate filing would be a Notice of Abandonment, which must be signed by the appellant himself but also noted that it would not be appropriate for counsel to discontinue the matter without receiving those specific instructions from the appellant. The Court was therefore minded to adjourn the matter to allow counsel to make contact with the appellant to discuss the way forward.
