Reason: On the last occasion counsel for the appellant indicated that the transcript of recordings was almost complete, however the audio for one of the hearing dates was missing. The Registrar of the High Court indicated that the missing audio recording had not been located and neither had she received the judge’s notes. The parties were encouraged to determine whether they can construct a transcript or notes of evidence from their personal notes pertaining to the hearing in question or whether the completed transcript is satisfactory for the purposes of the appeal. The Court recommended that the parties review counsel for the respondent’s notes since he was counsel in the court below and seek to agree to use them while the Registrar seeks to obtain the judge’s notes. The matter was therefore adjourned to the next status hearing of the Court. Counsel for the appellant informed the Court that there was no transcript as the sentencing for the appellant who pleaded guilty was done on paper and a sentencing judgment was produced. He further indicated that he was not aware of the existence of recordings. As a result, the parties agreed that the matter should proceed without the transcripts. The Court noted that the transcripts would need to be formally dispensed with, but the registry of the High Court indicated that it was experiences difficulties in extracting the audio. The Court therefore adjourned the matter to the next status hearing in Antigua and Barbuda to allow the Registrar to obtain the judge’s notes.
