The defendant Kimron Lawrence represented himself. ________________ 2025: MAY 06 ________________ SENTENCE For organised criminal activity in St Kitts & Nevis concerning drugs and guns Kimron Lawrence aged 39 (dob 17.09.85) and Akim Bartlette aged 30 (dob 05.05.95) face sentence following earliest practicable pleas of guilty on 04.02.25 to organised criminal activity concerning drugs and guns in St Kitts & Nevis during 01.01.20-04.03.21. Specifically on the indictment: a. Concerning count 1, being ‘engaging in organized criminal activity’ during 01.01.20- 04.03.21, contrary to s 3(1)(b) Organized Crime (Prevention and Control) Act cap 4.22, where there is a maximum of 25 years, both Lawrence and Bartlette pleaded; b. Concerning count 3, being ‘importation of component parts of a firearm’ on 04.03.21, contrary to s4(1) Firearms Act cap 19.05, where the sentence is at large, Bartlette pleaded, but on a basis he thought he was importing cannabis, accepted by the Crown; and c. Concerning count 6, being ‘possession of a firearm’ on 11.01.21, contrary to s20(1)(b) Firearms Act cap 19.05, where there is a maximum of 15 years1, Lawrence pleaded guilty. There were two other co-defendants: a. On 04.02.25, Shanika Gumbs, who was the girlfriend of Lawrence, pleaded guilty to count 6, and on 20.03.25 received 12 months imprisonment, which will be explained further below. b. On 04.02.25, Rodell Lewis was discontinued when pleas were entered as above by Lawrence, Bartlette, and Gumbs. Other counts not proceeded with regarding defendants who pleaded were to lie on file. Before setting out the facts, the history of proceedings was as follows: a. As the case hails from Nevis, it was originally a case on the docket of Thomspon J, but who recused himself, so it came to the instant judge for trial, to then sit on Nevis in place of Thompson J for the trial dates. b. The instant judge then first sat in the case on 01.02.24, by zoom, at which point there had already been a trial date fixed for 11.03.24. However, to understand the scale of the criminality, the case relies on many whatsapp voice notes, which had yet to be transcribed, and so proceedings became delayed awaiting transcription, and also by uncertainty as to who would represent Lawrence and Gumbs, at one stage being thought to be variously Counsels Natasha Gray, Hasani MacDonald, Thomas Astaphan KC, Craig Tuckett, and Hesketh Benjamin, but in the end they represented themselves. c. The case proceeded: i. On 09.02.24 by zoom for update; ii. Then on 23.02.24 by zoom the trial date was vacated as the transcriptions were not ready, creating a new trial date of 15.07.24; iii. Then there were hearings by zoom chasing the transcriptions and representation for Lawrence and Gumbs on 12.04, 03, 17, 23.05, 07, 14, and 28.06.24; iv. Then on 22.07.24, the case sat for jury trial on Nevis, though Lawrence and Gumbs were without representation, there now seemed not enough time to finish the case before the summer recess, on having studied the strength of the evidence Lawrence was remanded into custody as group leader, plus there were new voicenotes to transcribe concerning an absent party named Junai Gardener in Florida who had been in contact with Lawrence, all leading therefore to a new trial date being set for 24.09.24; v. Then on 01.08.24 by zoom for update; vi. Then on 18.09.24, by zoom the trial date of 24.09.24 was vacated, and with a new date set for 02.12.24; vii. Then by zoom on 18.10, 01, and 22.11.24, when the trial date of 02.12.24 was vacated; viii. Then on 06.12.24, sitting on Nevis, decision was taken the trial would be by judge alone, under the provisions of s5 Judge Alone Trials Act, Act 20 of 2024, recently in force since 20.09.24, and in parallel discussion began to settle the indictment with pleas acceptable to the prosecution; ix. Then on 16.12.24, sitting on Nevis, there was much further discussion over several hours to settle the indictment, with a new trial date set for 10.03.25; x. Then on 04.02.25, sitting on St Kitts, there were pleas, as above; xi. Then on 20.03.25, sitting on St Kitts, while Gumbs was sentenced separately, there was discussion on the extent of the criminality attributable to Lawrence and Bartlette, which it was decided may require a Newton Hearing; so that xii. Then on 28 and 30.04.25, sitting on St Kitts, there was discussion about the scale of the criminality, by reviewing voicenotes, with broadly agreement between the prosecution and defendants, and for sentencing remarks to be in writing to be delivered on St Kitts today, 06.05.25. Obiter, the court wishes to emphasise two features of this case: a. Most cases require transcription work, usually as to police audio interviews, and sometimes, as here, as to voicenotes and recordings on phones. This work ought to be done by the police, as part of their preparation of materials for consideration by the prosecution, and later if needed by the court and often a jury. It is not easy work as language is often in dialect, with strong accent, so words and meaning can be hard to decipher. It should not be a task for lawyers in the Office of the DPP (ODPP), who under-resourced have also the daily work of being in court presenting evidence, but instead ought to be coordinated by the lead officer in the case (OIC), being here Cpl Antonio Brown, who in fairness did produce the 293 transcripts of conversations between Lawrence and Junai Gardener, for which he is to be commended, while meriting conspicuous mention is ODPP junior Crown Counsel Althea Campbell who personally transcribed 114 relevant voicenotes between Lawrence, and Bartlette, Gumbs and an absent party named Nadia Maynard. b. Further, there has been particular cooperation between the parties which merits acknowledgement, including where Lawerence and Gumbs were unrepresented. It should through this judgment be more widely promulgated on Nevis that defendant cooperation with the prosecution and later then the court will most always be rewarded with lesser sentences, and often with acceptance of a lesser culpability, so that, if guilty, rather than run trials with convictions which may lead to maximum sentencing outcome, cooperation will usually produce a degree of clemency, meaning a discount for plea and a less onerous basis of facts. The facts On 04.03.21, at the Vance Amory airport on Nevis, investigators monitored the progress of a package which had arrived from the US on a Fedex flight. It was addressed to ‘Junai Gardener’, and was observed to be off-loaded from the flight onto a Fedex van being driven by Lewis, who had with him Bartlette, who was a junior customs office, who could be seen to check on the package three times. At 16.00hrs, the van was intercepted before clearing and the package was found in the passenger footwell. Bartlette said the package was his, and was a Bluetooth speaker, on inspection being an 8” portable pa speaker made by Pyle. Opening the back of the speaker were then found hidden, wrapped in white parchment paper, two Smith & Wesson upper-receivers for handguns, one for 0.38 cal and one for 0.40 cal. Bartlette and Lewis were arrested. Gumbs was arrested on 06.03.21 at her work, being Price Buster, following investigation into another Fedex shipment, and was seen to try to conceal a Samsung cellphone in a locker, which on analysis had been used by Lawrence, who was her boyfriend, who was interviewed on 07.03.21, and was found recorded on the phone talking to Maynard, who was then arrested on 12.07.21. Various charges against all five followed, though not Gardener who was in Florida, and later Maynard was discontinued in the magistrates court. Investigation by the white-collar crime unit (WCU) traced various moneywire transactions between Gardener and Gumbs, acting for Lawrence, between October 2020 and February 2021 being US$291.78 via Western Union and US$6921.44 via MoneyGram, totalling US$7213.22, sent by Gumbs to Gardener in Florida. Analysis of phones seized from the five revealed the following: a. Numbers of relevant voicenotes as follows: i. Lawrence talking with Bartlette – 99; ii. Lawrence talking with Gumbs – 3; iii. Lawrence talking with Maynard – 12; iv. Lawrence talking with Gardener – 293; and b. Two relevant videos as follows: i. Where Gardener shows Lawrence the space in the back of the Pyle speaker where contraband can be hidden; and ii. Where Gumbs takes a video of herself with Lawrence, dated 11.01.21, where she films him at night taking a handgun from his pocket, and brandishing it, pointing it at her, and sliding it alongside her neck, while she giggles, (where she never touched the gun, and so was sentenced on 20.03.25 as an accessory, not a principal, never exercising direct control over the gun, but as having encouraged his possession of it which had excited her). From analysis of the voicenotes, it is strikingly apparent Lawrence is the leader, and he recruited Bartlette as a customs officer to assist in importation of contraband, while Lawrence had a plan Gardener in Florida would buy many guns to smuggle to him. In parallel, there is discussion with Bartlette about previous importations of cannabis, seeming on 07.01.21, and 05.02.21, and other drugs, including a shipment that was intercepted much upsetting Lawrence, though not connected to Bartlette, seeming on 15.02.21, while Lawrence boasts graphically to Maynard of being the primary drug and guns kingpin on St Kitts & Nevis. a. At annex 1 below, there is a distillation of the 55 most notable voicenotes, of in total 407, between the five suspects, plus Gardener, as captured in January and February 2021. b. Concerning Bartlette, during discussion on 28 and 30.04.25 of the scale of the criminality, it has been accepted by the Crown and by counsel for Bartlette he was involved in importing cannabis twice, being an unknown commercial quantity, not more than 50kg in total, it appears on 07.01.21 and 05.02.21 per annex notes 1-20, and on 04.03.21 thought he was importing more cannabis, though in fact had facilitated importing the receivers. c. Concerning drugs, in the annex, there is reference to importing: i. ‘Weed’ (believed cannabis) in voicenote numbers 7, 15, 19, 27, 38, 41, 43, 44, and 45; ii. ‘White’ (believed cocaine) in 7; iii. ‘Powder’(believed cocaine) in 33, 41, and 43; and iv. ‘Heart’ (believed amphetamine or LSD) in 45. d. Concerning guns, there is discussion between Lawrence and Gardener about importing an AR assault rifle, and what seems planned to be tens of firearms, some with extender magazines, with prices for onward sale discussed; however, there is no evidence he had imported so many, or the AR, except for the video of 11.01.21 which shows he has acquired at least one handgun. In consequence, discussing matters on 30.04.25, it was decided the fairest approach was to determine Lawrence managed to import about 5 handguns, which would clearly be consistent as above with Gardener having received at least US$7000. e. To show how Lawrence saw himself as a master-criminal it is most revealing to read his voicenotes to Maynard, per annex notes 30-41, to whom he would boast she was mixing with ‘a big fucking drugs man wid a lot ah guns’ per note 30 and ‘Nadia you dealing wid ah, one de biggest fucking young drug lord, king pin inna fucking SKN!’ per note 38. It follows I will be sentencing a. Lawrence, as organized criminal activity, count 1, for importing cannabis twice, on about 07.01.21 and 05.02.21, trying to import drugs which were intercepted on about 15.02.21, planning to import other drugs, and having imported about 5 handguns, to include the two Smith & Wesson upper-receivers on 04.03.21, while being in possession of a handgun on 11.01.21, count 6; and b. Bartlette, as organised criminal activity, count 1, as a customs officer, for importing cannabis twice, on about 07.01.21 and 05.02.21, and thinking he was importing cannabis on 04.03.21, but in fact imported parts for the two Smith & Wesson pistols, count 3. As to mitigation: a. Lawrence has been commendably frank with the court, though representing himself, likely better than if by some counsel, noting: i. He has pointed out intelligently there is no actual evidence he ever imported any guns, just talk, though this is countered by his being in possession of one on 11.01.21, and his importing the two receivers on 04.03.21, which allow in my judgement an inference guns arrived, but I take his point about absence of evidence which has been fairly made, therefore limiting guns to about 5 in the context of what he explored with Gardener. ii. He has written to the court to own up to being responsible for what has happened to Bartlette and Gumbs, also saying in court the same, both of whom he has attempted to assist, arguing they did not know the extent of his activities, and at one point asking to serve their sentences for them. iii. He has no previous convictions, two children to whom he is close, being his son Tejary aged 7 and daughter Kezienique aged 2, and his social enquiry report by Isiah Liburd dated 14.03.25 mentions his generosity, with a former teacher and parliamentary candidate making positive comment on his character, and to this end the court observes from its interaction directly with him, he is clearly an affable, charismatic man, capable of being a leader within his community, though with a high opinion of himself, and it is his tragic flaw he has adopted the standing of being a major figure in Nevis criminality when he is capable of being a much better person. b. Bartlette also has no previous convictions, though this is to be expected as a customs officer, and from observing him in court, it is clear he is apprehensive about the sentence he faces, noting in his social enquiry report by Isiah Liburd dated 17.03.25 he has positive assessments from employers about how reliable and what a good worker he is, strongly suggesting to me he fell under the spell of Lawrence being genial, as did Gumbs, and took a path he now very much regrets. Constructing the sentence There are no sentencing guidelines specifically for ‘engaging in organised criminal’ activity, though it has been possible to look at existing guidelines for perspective. Concerning Lawrence: a. An approach to count 1, being engaged in organised criminal activity, would be to consider conspiracy to traffic in drugs and to import firearms. b. During discussion in court on 30.04.25, to be fairest to him, the quantity of cocaine imported would be less than 5kg and of cannabis less than 50kg, though the court is dealing with two cannabis importations, an intercepted importation seeming including cocaine, discussing importing much more drugs, importing about 5 guns, of which one is in the video of 11.01.21 and there are parts for two handguns inbound on 04.03.21. c. Per ss4 and 18 Drugs (prevention and abatement of the misuse of drugs) Act cap 9.08, drug trafficking carries a maximum of life imprisonment, treated as a notional 30 years in the guidelines, and within them it was agreed the drug quantity would attract a starting point in category 3A, where he has a leading role, meaning a starting point of 35%, being 10.5 years, if it were one importation, greatly aggravated by there being three, so that it would not be unreasonable to go to the maximum in the range, being 50%, or 15 years. d. In parallel, per s4 Firearms Act, for importation the sentence appears at large as it is unspecified, meaning notionally life, or 30 years for the guidelines, which would mean as group activity, not forgetting the context of trafficking in drugs too, a starting point in category 1A if 5 firearms, as 75% being 22.5 years, or 2A if perhaps less than 5, as 65% being 19.5 years, or if splitting the difference 21 years. e. While the drugs point to 15 years and the guns to perhaps 21 years, given the scale of the criminality, involving multiple drugs and contemplation of multiple types of firearms, in my judgement the starting point combined must be higher than 21 years. f. I remind myself the maximum for being engaged in organised criminal activity is 25 years, and this offending on analysis is exactly what the legislation was designed to capture, where in Lawrence’ own words to Maynard he is the biggest drug pin in St Kitts & Nevis, and so, drawing on the above corelations, in my judgment the starting point for Lawrence is close to the maximum, which I set above 21 years, as being 22.5 years. g. I then turn to consider the circumstances of the offender, noting: i. he is of good character, though by his own admission and voicenotes has been a frequent offender in January and February 2021, and ii. he has in a sense tried to be noble to rescue his friends from his leading them astray, while also not wasting the court’s time by pleading, which the court appreciates and will reward correctly with further discount, so that iii. in combination his good character and cooperation merit a reduction of 3 years to 19.5 years. h. I then turn to credit for plea, and though the case has had four trial listings – 11.03.24 15.07.24, 02.12.24 and 10.03.25 – I cannot ignore he has been unrepresented, while delays arose to do transcriptions, and for all defendants to settle on pleas acceptable the Crown, which has taken time, appropriately so, meaning I accept 04.02.25 was the first practicable opportunity to settle the indictment and will allow maximum credit, being of one third; this reduces the sentence to 13 years. i. I now turn to count 6, being possession of a firearm on 11.01.21, where the maximum in 2021 was then 15 years (though has increased in 2024): i. He is on video brandishing the firearm in public while Gumbs giggles; ii. The offence fits within category 2A as openly carried, and associated with drug supply, meaning a starting point of about 65%, meaning 9 years; iii. It is then reduced for good character and cooperation by 1.5 years to 7.5 years; iv. It is then reduced with credit for plea to 5 years. j. The reason Gumbs received only one year is she did not touch it, and her criminality was in being impressed by his having it, approving of it, and thereby encouraging his possession of it, and so she was as an accessory in a far lesser category of criminality; though meriting jail in any event, so that the word needs to be spread that to associate with a boyfriend who is armed, and to be impressed by this, giggling, will land a girlfriend in jail. k. The question now arises whether count 6 should be consecutive or concurrent to count 1, and in my judgement it should not be consecutive as it is part of the criminality embraced by count 1, though for totality merits a modest uplift as a distinct offence, brandishing a firearm in a public place, even if only to impress Gumbs, graphically and intimidatingly caught on video, so that I would uplift by one year to 14 years. l. To reflect the uplift for totality, I will increase the sentence for count 1 to 14 years and make the 5 years on count 6 run concurrently. Concerning Bartlette: a. An approach to count 1, being engaged in organised criminal activity, is to consider conspiracy to traffic in drugs, bearing in mind the Crown have not sought to gainsay this, although he found himself importing the Smith & Wesson receivers on 04.03.21, he only ever thought he was importing cannabis, which through Counsel Henderson, who is to be commended for his intelligent assistance to Bartlette, he has accepted occurred twice earlier, on it seems 07.01.21 and 05.02.21. b. During discussion in court on 30.04.25, the quantity of cannabis imported would be less than 50kg, though the court is dealing with two cannabis importations, plus what was supposed to be a third cannabis importation on 04.03.21. c. Per ss4 and 18 Drugs (prevention and abatement of the misuse of drugs) Act cap 9.08, drug trafficking carries a maximum of life imprisonment, treated as a notional 30 years in the guidelines, and within them it was agreed would attract a starting point in category 3B, where he has a significant role, meaning a starting point of 20%, being 6 years, if it were one importation, greatly aggravated by there being three, including he thought on 04.03.21, so that it would not be unreasonable to go to the maximum in the range, being 30%, or 9 years. d. There is however a further considerably aggravating further feature, being he was a junior customs officer, selected to participate precisely owing to his role to aid importation, in gross breach of trust of his office, meriting an uplift in the sentence by 2 years to 11 years. e. A further insight may be gained by looking at the offence of corruption, contrary to ss4 and 9 Organised Crime (prevention and control) Act, where the maximum is 15 years. The guidelines for corruption would suggest it falls into category 2A, as causing significant undermining of the proper function of government, with as corruption a leading role, being that of a customs officer clearing contraband, meaning a starting point of 60%, or 9 years, with uplift to 11 years for there being three importations, leading to the same figure as above. f. Yet a further approach might be to consider another type of corruption, being misconduct in a public office, as a customs officer, where the sentence is at large, being therefore a notional 30 year maximum, which would mean, using the corruption sentencing guideline, the same 2A starting point of 60%, meaning 18 years, being twice as high for the s4 corruption offence. However, misconduct was count 4 on the trial indictment, which in accepting the pleas the prosecution agreed not to pursue further, and there existing s4 corruption with a lesser maximum, as above, it would not in my judgement be fair to apply this greater misconduct maximum when the lesser is in parallel available. g. The circumstances of the offence meriting 11 years, I turn then to consider circumstances pertaining to the offender, and while I note he is of good character, this has muted mitigating effect as he had to have this to be a customs officer, while hardworking, though is expected to be, and so I allow a discount of 6 months, reducing the sentence to 10.5 years. h. I turn then to consider credit for plea, being of one-third, so this reduces the sentence by 3.5 years to 7 years. i. I now to turn to count 3, being importation of component parts of a firearm on 04.03.21, being the receivers, which for s2 Firearms Act constitute a ‘firearm’, noting it is a feature of caselaw and jurisprudence contemplating mens rea he is guilty of their importation even if he thought the illegal importation was of cannabis. However, as above, I have approached this sentencing on the basis of what he thought, not what was in the speaker, and what he did on 04.03.21 is already fully reflected in count 1 as a feature of the organised criminal activity, namely he was engaged in importing cannabis. If a single drugs offence, being less than 50kg, it would be category 3B, as discussed above, starting at 6 years, uplifted for breach of trust to 8 years, discounted 6 months for his character to 7.5 years, discounted for plea to 5 years; but this offence is already fully embraced by count 1, meaning any such sentence must be wholly concurrent. Time on remand in respect of both will count, which in the case of Lawrence I declare to be 9 months and 13 days, and in the case of Bartlette I declare to be 7 days to be factored by the prison2 in calculating their earliest dates of release. The two receivers intercepted on 04.03.21 are confiscated, to be used by police as needed. Kimron Lawrence and Akim Bartlette, please stand up. For the reasons explained, on pleas of guilty: a. Kimron Lawrence, on count 1 for being engaged in organised criminal activity during 01.01.20-04.03.21, namely to import guns and multiple types of drugs, the sentence shall be 14 years on count 1, and on count 6, there shall be 5 years concurrent for possession of a firearm on 11.01.21, making a total sentence of 14 years. b. Akim Bartlette, on count 1 for being engaged in organised criminal activity during 01.01.20- 04.03.21, namely to import as a customs officer cannabis, on about 07.01.21, 05.02.21, and on 04.03.21, the sentence shall be 7 years imprisonment, and on count 3, for importation of two Smith & Wesson receivers on 04.03.21 believing you were importing cannabis, there shall be 5 years imprisonment concurrent, making a total sentence of 7 years. c. Time on remand shall count, and you shall each be eligible for remission of one-third of your sentence if of good behaviour. You may both go with the gaoler. The Hon. IN THE EASTERN CARIBBEAN SUPREME COURT IN THE HIGH COURT OF JUSTICE IN THE FEDERATION OF ST CHRISTOPHER & NEVIS IN NEVIS CIRCUIT CASE NEVHCR 2023/0007 REX V KIMRON LAWRENCE AKIM BARTLETTE APPEARANCES Mr Teshaun Vasquez and Ms Althea Campbell for the Crown. Mr Vaughan Henderson for the defendant Bartlette. The defendant Kimron Lawrence represented himself. ________________ 2025: MAY 06 ________________ SENTENCE For organised criminal activity in St Kitts & Nevis concerning drugs and guns 1 Kimron Lawrence aged 39 (dob 17.09.85) and Akim Bartlette aged 30 (dob 05.05.95) face sentence following earliest practicable pleas of guilty on 04.02.25 to organised criminal activity concerning drugs and guns in St Kitts & Nevis during 01.01.20-04.03.21. 2 Specifically on the indictment: a. Concerning count 1, being ‘engaging in organized criminal activity’ during 01.01.20-04.03.21, contrary to s 3(1)(b) Organized Crime (Prevention and Control) Act cap 4.22, where there is a maximum of 25 years, both Lawrence and Bartlette pleaded; b. Concerning count 3, being ‘importation of component parts of a firearm’ on 04.03.21, contrary to s4(1) Firearms Act cap 19.05, where the sentence is at large, Bartlette pleaded, but on a basis he thought he was importing cannabis, accepted by the Crown; and c. Concerning count 6, being ‘possession of a firearm’ on 11.01.21, contrary to s20(1)(b) Firearms Act cap 19.05, where there is a maximum of 15 years , Lawrence pleaded guilty. 3 There were two other co-defendants: a. On 04.02.25, Shanika Gumbs, who was the girlfriend of Lawrence, pleaded guilty to count 6, and on 20.03.25 received 12 months imprisonment, which will be explained further below. b. On 04.02.25, Rodell Lewis was discontinued when pleas were entered as above by Lawrence, Bartlette, and Gumbs. 4 Other counts not proceeded with regarding defendants who pleaded were to lie on file. 5 Before setting out the facts, the history of proceedings was as follows: a. As the case hails from Nevis, it was originally a case on the docket of Thomspon J, but who recused himself, so it came to the instant judge for trial, to then sit on Nevis in place of Thompson J for the trial dates. b. The instant judge then first sat in the case on 01.02.24, by zoom, at which point there had already been a trial date fixed for 11.03.24. However, to understand the scale of the criminality, the case relies on many whatsapp voice notes, which had yet to be transcribed, and so proceedings became delayed awaiting transcription, and also by uncertainty as to who would represent Lawrence and Gumbs, at one stage being thought to be variously Counsels Natasha Gray, Hasani MacDonald, Thomas Astaphan KC, Craig Tuckett, and Hesketh Benjamin, but in the end they represented themselves. c. The case proceeded: i. On 09.02.24 by zoom for update; ii. Then on 23.02.24 by zoom the trial date was vacated as the transcriptions were not ready, creating a new trial date of 15.07.24; iii. Then there were hearings by zoom chasing the transcriptions and representation for Lawrence and Gumbs on 12.04, 03, 17, 23.05, 07, 14, and 28.06.24; iv. Then on 22.07.24, the case sat for jury trial on Nevis, though Lawrence and Gumbs were without representation, there now seemed not enough time to finish the case before the summer recess, on having studied the strength of the evidence Lawrence was remanded into custody as group leader, plus there were new voicenotes to transcribe concerning an absent party named Junai Gardener in Florida who had been in contact with Lawrence, all leading therefore to a new trial date being set for 24.09.24; v. Then on 01.08.24 by zoom for update; vi. Then on 18.09.24, by zoom the trial date of 24.09.24 was vacated, and with a new date set for 02.12.24; vii. Then by zoom on 18.10, 01, and 22.11.24, when the trial date of 02.12.24 was vacated; viii. Then on 06.12.24, sitting on Nevis, decision was taken the trial would be by judge alone, under the provisions of s5 Judge Alone Trials Act, Act 20 of 2024, recently in force since 20.09.24, and in parallel discussion began to settle the indictment with pleas acceptable to the prosecution; ix. Then on 16.12.24, sitting on Nevis, there was much further discussion over several hours to settle the indictment, with a new trial date set for 10.03.25; x. Then on 04.02.25, sitting on St Kitts, there were pleas, as above; xi. Then on 20.03.25, sitting on St Kitts, while Gumbs was sentenced separately, there was discussion on the extent of the criminality attributable to Lawrence and Bartlette, which it was decided may require a Newton Hearing; so that xii. Then on 28 and 30.04.25, sitting on St Kitts, there was discussion about the scale of the criminality, by reviewing voicenotes, with broadly agreement between the prosecution and defendants, and for sentencing remarks to be in writing to be delivered on St Kitts today, 06.05.25. 6 Obiter, the court wishes to emphasise two features of this case: a. Most cases require transcription work, usually as to police audio interviews, and sometimes, as here, as to voicenotes and recordings on phones. This work ought to be done by the police, as part of their preparation of materials for consideration by the prosecution, and later if needed by the court and often a jury. It is not easy work as language is often in dialect, with strong accent, so words and meaning can be hard to decipher. It should not be a task for lawyers in the Office of the DPP (ODPP), who under-resourced have also the daily work of being in court presenting evidence, but instead ought to be coordinated by the lead officer in the case (OIC), being here Cpl Antonio Brown, who in fairness did produce the 293 transcripts of conversations between Lawrence and Junai Gardener, for which he is to be commended, while meriting conspicuous mention is ODPP junior Crown Counsel Althea Campbell who personally transcribed 114 relevant voicenotes between Lawrence, and Bartlette, Gumbs and an absent party named Nadia Maynard. b. Further, there has been particular cooperation between the parties which merits acknowledgement, including where Lawerence and Gumbs were unrepresented. It should through this judgment be more widely promulgated on Nevis that defendant cooperation with the prosecution and later then the court will most always be rewarded with lesser sentences, and often with acceptance of a lesser culpability, so that, if guilty, rather than run trials with convictions which may lead to maximum sentencing outcome, cooperation will usually produce a degree of clemency, meaning a discount for plea and a less onerous basis of facts. The facts 7 On 04.03.21, at the Vance Amory airport on Nevis, investigators monitored the progress of a package which had arrived from the US on a Fedex flight. It was addressed to ‘Junai Gardener’, and was observed to be off-loaded from the flight onto a Fedex van being driven by Lewis, who had with him Bartlette, who was a junior customs office, who could be seen to check on the package three times. At 16.00hrs, the van was intercepted before clearing and the package was found in the passenger footwell. Bartlette said the package was his, and was a Bluetooth speaker, on inspection being an 8” portable pa speaker made by Pyle. Opening the back of the speaker were then found hidden, wrapped in white parchment paper, two Smith & Wesson upper-receivers for handguns, one for 0.38 cal and one for 0.40 cal. Bartlette and Lewis were arrested. Gumbs was arrested on 06.03.21 at her work, being Price Buster, following investigation into another Fedex shipment, and was seen to try to conceal a Samsung cellphone in a locker, which on analysis had been used by Lawrence, who was her boyfriend, who was interviewed on 07.03.21, and was found recorded on the phone talking to Maynard, who was then arrested on 12.07.21. Various charges against all five followed, though not Gardener who was in Florida, and later Maynard was discontinued in the magistrates court. 8 Investigation by the white-collar crime unit (WCU) traced various moneywire transactions between Gardener and Gumbs, acting for Lawrence, between October 2020 and February 2021 being US$291.78 via Western Union and US$6921.44 via MoneyGram, totalling US$7213.22, sent by Gumbs to Gardener in Florida. 9 Analysis of phones seized from the five revealed the following: a. Numbers of relevant voicenotes as follows: i. Lawrence talking with Bartlette – 99; ii. Lawrence talking with Gumbs – 3; iii. Lawrence talking with Maynard – 12; iv. Lawrence talking with Gardener – 293; and b. Two relevant videos as follows: i. Where Gardener shows Lawrence the space in the back of the Pyle speaker where contraband can be hidden; and ii. Where Gumbs takes a video of herself with Lawrence, dated 11.01.21, where she films him at night taking a handgun from his pocket, and brandishing it, pointing it at her, and sliding it alongside her neck, while she giggles, (where she never touched the gun, and so was sentenced on 20.03.25 as an accessory, not a principal, never exercising direct control over the gun, but as having encouraged his possession of it which had excited her). 10 From analysis of the voicenotes, it is strikingly apparent Lawrence is the leader, and he recruited Bartlette as a customs officer to assist in importation of contraband, while Lawrence had a plan Gardener in Florida would buy many guns to smuggle to him. In parallel, there is discussion with Bartlette about previous importations of cannabis, seeming on 07.01.21, and 05.02.21, and other drugs, including a shipment that was intercepted much upsetting Lawrence, though not connected to Bartlette, seeming on 15.02.21, while Lawrence boasts graphically to Maynard of being the primary drug and guns kingpin on St Kitts & Nevis. a. At annex 1 below, there is a distillation of the 55 most notable voicenotes, of in total 407, between the five suspects, plus Gardener, as captured in January and February 2021. b. Concerning Bartlette, during discussion on 28 and 30.04.25 of the scale of the criminality, it has been accepted by the Crown and by counsel for Bartlette he was involved in importing cannabis twice, being an unknown commercial quantity, not more than 50kg in total, it appears on 07.01.21 and 05.02.21 per annex notes 1-20, and on 04.03.21 thought he was importing more cannabis, though in fact had facilitated importing the receivers. c. Concerning drugs, in the annex, there is reference to importing: i. ‘Weed’ (believed cannabis) in voicenote numbers 7, 15, 19, 27, 38, 41, 43, 44, and 45; ii. ‘White’ (believed cocaine) in 7; iii. ‘Powder’(believed cocaine) in 33, 41, and 43; and iv. ‘Heart’ (believed amphetamine or LSD) in 45. d. Concerning guns, there is discussion between Lawrence and Gardener about importing an AR assault rifle, and what seems planned to be tens of firearms, some with extender magazines, with prices for onward sale discussed; however, there is no evidence he had imported so many, or the AR, except for the video of 11.01.21 which shows he has acquired at least one handgun. In consequence, discussing matters on 30.04.25, it was decided the fairest approach was to determine Lawrence managed to import about 5 handguns, which would clearly be consistent as above with Gardener having received at least US$7000. e. To show how Lawrence saw himself as a master-criminal it is most revealing to read his voicenotes to Maynard, per annex notes 30-41, to whom he would boast she was mixing with ‘a big fucking drugs man wid a lot ah guns’ per note 30 and ‘Nadia you dealing wid ah, one de biggest fucking young drug lord, king pin inna fucking SKN!’ per note 38. 11 It follows I will be sentencing a. Lawrence, as organized criminal activity, count 1, for importing cannabis twice, on about 07.01.21 and 05.02.21, trying to import drugs which were intercepted on about 15.02.21, planning to import other drugs, and having imported about 5 handguns, to include the two Smith & Wesson upper-receivers on 04.03.21, while being in possession of a handgun on 11.01.21, count 6; and b. Bartlette, as organised criminal activity, count 1, as a customs officer, for importing cannabis twice, on about 07.01.21 and 05.02.21, and thinking he was importing cannabis on 04.03.21, but in fact imported parts for the two Smith & Wesson pistols, count 3. 12 As to mitigation: a. Lawrence has been commendably frank with the court, though representing himself, likely better than if by some counsel, noting: i. He has pointed out intelligently there is no actual evidence he ever imported any guns, just talk, though this is countered by his being in possession of one on 11.01.21, and his importing the two receivers on 04.03.21, which allow in my judgement an inference guns arrived, but I take his point about absence of evidence which has been fairly made, therefore limiting guns to about 5 in the context of what he explored with Gardener. ii. He has written to the court to own up to being responsible for what has happened to Bartlette and Gumbs, also saying in court the same, both of whom he has attempted to assist, arguing they did not know the extent of his activities, and at one point asking to serve their sentences for them. iii. He has no previous convictions, two children to whom he is close, being his son Tejary aged 7 and daughter Kezienique aged 2, and his social enquiry report by Isiah Liburd dated 14.03.25 mentions his generosity, with a former teacher and parliamentary candidate making positive comment on his character, and to this end the court observes from its interaction directly with him, he is clearly an affable, charismatic man, capable of being a leader within his community, though with a high opinion of himself, and it is his tragic flaw he has adopted the standing of being a major figure in Nevis criminality when he is capable of being a much better person. b. Bartlette also has no previous convictions, though this is to be expected as a customs officer, and from observing him in court, it is clear he is apprehensive about the sentence he faces, noting in his social enquiry report by Isiah Liburd dated 17.03.25 he has positive assessments from employers about how reliable and what a good worker he is, strongly suggesting to me he fell under the spell of Lawrence being genial, as did Gumbs, and took a path he now very much regrets. Constructing the sentence 13 There are no sentencing guidelines specifically for ‘engaging in organised criminal’ activity, though it has been possible to look at existing guidelines for perspective. 14 Concerning Lawrence: a. An approach to count 1, being engaged in organised criminal activity, would be to consider conspiracy to traffic in drugs and to import firearms. b. During discussion in court on 30.04.25, to be fairest to him, the quantity of cocaine imported would be less than 5kg and of cannabis less than 50kg, though the court is dealing with two cannabis importations, an intercepted importation seeming including cocaine, discussing importing much more drugs, importing about 5 guns, of which one is in the video of 11.01.21 and there are parts for two handguns inbound on 04.03.21. c. Per ss4 and 18 Drugs (prevention and abatement of the misuse of drugs) Act cap 9.08, drug trafficking carries a maximum of life imprisonment, treated as a notional 30 years in the guidelines, and within them it was agreed the drug quantity would attract a starting point in category 3A, where he has a leading role, meaning a starting point of 35%, being 10.5 years, if it were one importation, greatly aggravated by there being three, so that it would not be unreasonable to go to the maximum in the range, being 50%, or 15 years. d. In parallel, per s4 Firearms Act, for importation the sentence appears at large as it is unspecified, meaning notionally life, or 30 years for the guidelines, which would mean as group activity, not forgetting the context of trafficking in drugs too, a starting point in category 1A if 5 firearms, as 75% being 22.5 years, or 2A if perhaps less than 5, as 65% being 19.5 years, or if splitting the difference 21 years. e. While the drugs point to 15 years and the guns to perhaps 21 years, given the scale of the criminality, involving multiple drugs and contemplation of multiple types of firearms, in my judgement the starting point combined must be higher than 21 years. f. I remind myself the maximum for being engaged in organised criminal activity is 25 years, and this offending on analysis is exactly what the legislation was designed to capture, where in Lawrence’ own words to Maynard he is the biggest drug pin in St Kitts & Nevis, and so, drawing on the above corelations, in my judgment the starting point for Lawrence is close to the maximum, which I set above 21 years, as being 22.5 years. g. I then turn to consider the circumstances of the offender, noting: i. he is of good character, though by his own admission and voicenotes has been a frequent offender in January and February 2021, and ii. he has in a sense tried to be noble to rescue his friends from his leading them astray, while also not wasting the court’s time by pleading, which the court appreciates and will reward correctly with further discount, so that iii. in combination his good character and cooperation merit a reduction of 3 years to 19.5 years. h. I then turn to credit for plea, and though the case has had four trial listings – 11.03.24 15.07.24, 02.12.24 and 10.03.25 – I cannot ignore he has been unrepresented, while delays arose to do transcriptions, and for all defendants to settle on pleas acceptable the Crown, which has taken time, appropriately so, meaning I accept 04.02.25 was the first practicable opportunity to settle the indictment and will allow maximum credit, being of one third; this reduces the sentence to 13 years. i. I now turn to count 6, being possession of a firearm on 11.01.21, where the maximum in 2021 was then 15 years (though has increased in 2024): i. He is on video brandishing the firearm in public while Gumbs giggles; ii. The offence fits within category 2A as openly carried, and associated with drug supply, meaning a starting point of about 65%, meaning 9 years; iii. It is then reduced for good character and cooperation by 1.5 years to 7.5 years; iv. It is then reduced with credit for plea to 5 years. j. The reason Gumbs received only one year is she did not touch it, and her criminality was in being impressed by his having it, approving of it, and thereby encouraging his possession of it, and so she was as an accessory in a far lesser category of criminality; though meriting jail in any event, so that the word needs to be spread that to associate with a boyfriend who is armed, and to be impressed by this, giggling, will land a girlfriend in jail. k. The question now arises whether count 6 should be consecutive or concurrent to count 1, and in my judgement it should not be consecutive as it is part of the criminality embraced by count 1, though for totality merits a modest uplift as a distinct offence, brandishing a firearm in a public place, even if only to impress Gumbs, graphically and intimidatingly caught on video, so that I would uplift by one year to 14 years. l. To reflect the uplift for totality, I will increase the sentence for count 1 to 14 years and make the 5 years on count 6 run concurrently. 15 Concerning Bartlette: a. An approach to count 1, being engaged in organised criminal activity, is to consider conspiracy to traffic in drugs, bearing in mind the Crown have not sought to gainsay this, although he found himself importing the Smith & Wesson receivers on 04.03.21, he only ever thought he was importing cannabis, which through Counsel Henderson, who is to be commended for his intelligent assistance to Bartlette, he has accepted occurred twice earlier, on it seems 07.01.21 and 05.02.21. b. During discussion in court on 30.04.25, the quantity of cannabis imported would be less than 50kg, though the court is dealing with two cannabis importations, plus what was supposed to be a third cannabis importation on 04.03.21. c. Per ss4 and 18 Drugs (prevention and abatement of the misuse of drugs) Act cap 9.08, drug trafficking carries a maximum of life imprisonment, treated as a notional 30 years in the guidelines, and within them it was agreed would attract a starting point in category 3B, where he has a significant role, meaning a starting point of 20%, being 6 years, if it were one importation, greatly aggravated by there being three, including he thought on 04.03.21, so that it would not be unreasonable to go to the maximum in the range, being 30%, or 9 years. d. There is however a further considerably aggravating further feature, being he was a junior customs officer, selected to participate precisely owing to his role to aid importation, in gross breach of trust of his office, meriting an uplift in the sentence by 2 years to 11 years. e. A further insight may be gained by looking at the offence of corruption, contrary to ss4 and 9 Organised Crime (prevention and control) Act, where the maximum is 15 years. The guidelines for corruption would suggest it falls into category 2A, as causing significant undermining of the proper function of government, with as corruption a leading role, being that of a customs officer clearing contraband, meaning a starting point of 60%, or 9 years, with uplift to 11 years for there being three importations, leading to the same figure as above. f. Yet a further approach might be to consider another type of corruption, being misconduct in a public office, as a customs officer, where the sentence is at large, being therefore a notional 30 year maximum, which would mean, using the corruption sentencing guideline, the same 2A starting point of 60%, meaning 18 years, being twice as high for the s4 corruption offence. However, misconduct was count 4 on the trial indictment, which in accepting the pleas the prosecution agreed not to pursue further, and there existing s4 corruption with a lesser maximum, as above, it would not in my judgement be fair to apply this greater misconduct maximum when the lesser is in parallel available. g. The circumstances of the offence meriting 11 years, I turn then to consider circumstances pertaining to the offender, and while I note he is of good character, this has muted mitigating effect as he had to have this to be a customs officer, while hardworking, though is expected to be, and so I allow a discount of 6 months, reducing the sentence to 10.5 years. h. I turn then to consider credit for plea, being of one-third, so this reduces the sentence by 3.5 years to 7 years. i. I now to turn to count 3, being importation of component parts of a firearm on 04.03.21, being the receivers, which for s2 Firearms Act constitute a ‘firearm’, noting it is a feature of caselaw and jurisprudence contemplating mens rea he is guilty of their importation even if he thought the illegal importation was of cannabis. However, as above, I have approached this sentencing on the basis of what he thought, not what was in the speaker, and what he did on 04.03.21 is already fully reflected in count 1 as a feature of the organised criminal activity, namely he was engaged in importing cannabis. If a single drugs offence, being less than 50kg, it would be category 3B, as discussed above, starting at 6 years, uplifted for breach of trust to 8 years, discounted 6 months for his character to 7.5 years, discounted for plea to 5 years; but this offence is already fully embraced by count 1, meaning any such sentence must be wholly concurrent. 16 Time on remand in respect of both will count, which in the case of Lawrence I declare to be 9 months and 13 days, and in the case of Bartlette I declare to be 7 days to be factored by the prison in calculating their earliest dates of release. 17 The two receivers intercepted on 04.03.21 are confiscated, to be used by police as needed. 18 Kimron Lawrence and Akim Bartlette, please stand up. For the reasons explained, on pleas of guilty: a. Kimron Lawrence, on count 1 for being engaged in organised criminal activity during 01.01.20-04.03.21, namely to import guns and multiple types of drugs, the sentence shall be 14 years on count 1, and on count 6, there shall be 5 years concurrent for possession of a firearm on 11.01.21, making a total sentence of 14 years. b. Akim Bartlette, on count 1 for being engaged in organised criminal activity during 01.01.20-04.03.21, namely to import as a customs officer cannabis, on about 07.01.21, 05.02.21, and on 04.03.21, the sentence shall be 7 years imprisonment, and on count 3, for importation of two Smith & Wesson receivers on 04.03.21 believing you were importing cannabis, there shall be 5 years imprisonment concurrent, making a total sentence of 7 years. c. Time on remand shall count, and you shall each be eligible for remission of one-third of your sentence if of good behaviour. You may both go with the gaoler. The Hon.
